  • Guide to Employer Forms 

    1. IRS Form SS-4 – Application for Employer Identification Number - This form is used to obtain an Employer Identification Number. If you already have a Federal Employer Identification number, please complete the form and provide proof of your EIN number. If you do NOT have an EIN # you will need to complete the form and send it back to Morning Sun Financial Services.

    1. If you do OR do not have a FEIN, please complete ONLY Lines 1, 5a, 5b, 6, 7a, and 7b. NOTE: In line 7b, please enter the Employer Social Security Number and NOT your existing FEIN (if applicable). The IRS will not order a new FEIN or validate an existing FEIN without a valid social security number.
    2. Please print and sign your name at the bottom of the form, and include your telephone number in the appropriate box. Please make sure your signature and date is in blue or black ink and is not a digital signature, as the IRS will not accept form SS4 if it is digitally signed and dated.

    2. IRS Form 2678 – Employer / Payer Appointment of Agent – This form gives authorization for Morning Sun Financial Services to act as your Payroll Agent. Please complete the highlighted lines in Part 2 of this form and return it to Morning Sun Financial Services.

    1. Employer Identification Number (if you have an EIN or know your EIN – otherwise leave it blank).
    2. Employer’s Name.
    3. Employer’s home mailing address.
    4. At the bottom of Part 2 on page 1 – sign, date, printed name, telephone number.

    3. IRS Form 8821 – Tax Information Authorization – This form authorizes Morning Sun Financial Services to inquire and request information related to payroll reports with the IRS on your behalf.

    2. Please complete all of section 7.

    4. South Carolina Dept. of Revenue Form SC 2848 – Power of Attorney and Declaration of Representative – This form authorizes Morning Sun to represent your business before the Department of Revenue and complete necessary filings.

    5. South Carolina Dept. of Revenue Form SCDOR-11 – Tax Registration Application – This form allows for Morning Sun to open a state income tax account if one has not already been opened.

    6. South Carolina Dept. of Employment and Workforce Form UCE-151 – Employer Status Report – This form allows for Morning Sun to open an unemployment insurance account if one has not already been opened

    7. South Carolina Dept. of Employment and Workforce Form UCE-1010 – Written Authorization – This form allows Morning Sun to act as your agent and to discuss/file your business unemployment insurance.

    8. Morning Sun Service Agreement – This form is a Service Agreement between person served and/or the employer and Morning Sun Financial Services.

    9. E-Verify Memorandum of Understanding – This form authorizes Morning Sun to act on your behalf to check employment eligibility for the individuals hired.

  • MSFS is in the business of providing financial management services to certain individuals and the Employer who is an individual, or his or her representative, that is hiring and managing his or her own support through waiver amendments. Employer desires to hire MSFS to perform certain payroll and tax management, billing and support services related to the waiver amendments. Accordingly, we agree as follows:

    1. Duties. During the term of this Agreement:

    Employer is responsible to hire and manage his/her own support as part of self-directed services. This means You are responsible for:

    • Recruiting, hiring and terminating employees
    • Establishing performance evaluation criteria for each employee
    • Establishing schedules and tasks to be completed by employees
    • Keeping track of services received
    • Contacting MSFS for issues regarding your employee’s payroll

    MSFS is responsible for:

    • Issuing paychecks to your employees
    • Withholding appropriate federal and state taxes for each employee
    • Filing monthly, quarterly and annual forms and tax deposits with federal and state agencies
    • Issuing W-2 Statements to each employee by January 31 each year

    2. Employer Forms. MSFS will supply You with a packet of information containing forms and instructions to establish You as the employer. After You have completed the forms, MSFS will file these forms on Your behalf with the appropriate state and federal agencies.

    3. Insurance. MSFS does not provide insurance to You. If You want additional insurance, You will need to obtain that on Your own. These insurances may include Professional and General Liability and Property Insurance.

    4. Taxes. MSFS is responsible for the payment of all Employer payroll taxes, whether federal, state, or local, related to your role as employer as well as Your employees and
    their related withholding taxes.

    5. Indemnification. MSFS shall not be liable to You or Your representatives, employees, or agents for any loss, damage, injury or expense You or they suffer in connection with the performance of this Agreement. You agree to indemnify and hold MSFS harmless from any such that may be made against MSFS as a result of Your misconduct or negligence or that of Your employees, or agents in connection with the performance of services described in this Agreement.

    6. Laws and Regulations. MSFS agrees that it will comply with all federal, state, and
    local laws and regulations pertaining to these services.

  • What is Worker’s Compensation Insurance? Worker’s compensation insurance is a specific type of business insurance that provides benefits to employees who suffer work-related injuries or illnesses. This insurance can cover lost wages while they are out of work, medical expenses, and more. Worker’s Compensation coverage can protect both the employer and the employee in the result of a work-related injury.

    Am I required to have worker’s compensation? No – if you employ less than four employees, then household employers may be exempt from this requirement. However, if you hire four or more employees, then you must provide worker’s compensation. *Part time workers and family members are counted as employees.

    If I have less than four employees and choose not to provide Worker’s Compensation, will my employees still have this coverage? No – your employees will not be covered. You may become liable for lost wages, medical care, and more should an employee be injured while working. Your homeowner’s insurance may or may not give you a small protection and this may be an additional coverage you have to purchase. You must contact your homeowner’s insurance agent to determine this. This is not a substitute for a full worker’s compensation insurance coverage.

    If I choose or become required to provide worker’s compensation coverage, where do I go to purchase workers’ compensation insurance? Workers’ compensation insurance coverage can be obtained via a commercial insurance carrier licensed to write workers’ compensation insurance coverage in the state of South Carolina or via the state’s assigned risk program, which is administered by the National Council on Compensation Insurance (NCCI).

  • Employers are expected to independently research and follow federal and state employment laws when hiring, supervising, disciplining, and terminating employees.     Hiring Employees 

    • Employers must not discriminate against advertising a job or hiring an employee based on that person's race, color, religion, sex (including gender identity, sexual orientation, and pregnancy), national origin, age (40 or older), disability or genetic information.
    • Interview questions should be relevant to the job the employee is applying to, not an employee’s personal traits or background.
    • Correctly classify workers as employees and NOT independent contractors when they hire a worker.
    • Only hire employees that are eligible to work in the United States. Employers are required to complete form I-9 to verify the employee’s eligibility.

    Supervising/Disciplining Employees

    • It is illegal to discriminate against someone because of that person's race, color, religion, sex (including gender identity, sexual orientation, and pregnancy), national origin, age (40 or older), disability or genetic information. It is also illegal to retaliate against a person because he or she complained about discrimination, filed a charge of discrimination, or participated in an employment discrimination investigation or lawsuit. This includes using these traits when considering promotions, job assignments, and wages.
    • Employees must legally be paid at least minimum wage. Employees must receive overtime pay for hours worked over 40 in a workweek at a rate not less than time and one-half their regular rates of pay
    • Employers should provide a safe work environment for employees. This includes a physical work environment free from serious recognized hazards, violence, and other dangerous conditions. This also includes providing employees a work environment free from unwelcome or offensive behavior in the workplace, which causes one or more employees to feel uncomfortable, scared, or intimidated in their place of employment.

    Terminating Employees

    • Employers and employees may terminate the employment relationship at any point for any reason and without warning as long as the reasoning is not illegal since South Carolina is an Employment at Will state. An employer may not terminate an employee based on a person's race, color, religion, sex (including gender identity, sexual orientation, and pregnancy), national origin, age (40 or older), disability or genetic information.
    • Employers should notify their case manager and/or Morning Sun Financial Services immediately following an employment termination so that state law for the employee’s final pay can be followed.
